Long-Term Care Planning

With the cost of long-term care skyrocketing to as much as $15,000 per month, you cannot afford to wait until you need long-term care to create an asset preservation strategy. Under the Medicaid regulations, any unexplained transaction within the five years prior to applying for Medicaid, can be subject to a penalty. The Law Office of Michael Heinemann, PC will create an asset protection strategy to preserve your life savings, should the need for long-term care arise. Through the use of Medicaid compliant trusts and other asset preservation strategies, you can ensure that your hard-earned assets will be protected for your family, should you require long-term care in the future.

Powers-of-Attorney

The Law Office of Michael Heinemann, PC can assist with the drafting and updating of a power-of-attorney. Powers-of-attorney are a vital component of any elder planning strategy. With a properly drafted power-of-attorney, our clients avoid unnecessary complications as they age, such as guardianships and difficulty accessing assets and personal information when time is of the essence.

Medicaid Crisis Planning

Medicaid Crisis Planning refers to individuals who are about to begin or are already in the process of Medicaid spend-down and have not previously created an effective long-term planning strategy. With the cost of long-term care currently at $12,000–$15,000 per month, you need to act fast to prevent all of your remaining assets from being spent on long-term care. The Law Office of Michael Heinemann, PC is proficient in advanced asset preservation techniques, such as Medicaid compliant annuities which can be used to preserve a significant portion of the remaining assets while at the same time expedite Medicaid eligibility. We work quickly and efficiently under these circumstances, as time is of the essence, to preserve as much of our clients' assets as possible.

Guardianships

The Law Office of Michael Heinemann, PC can help if your loved one has become incapacitated and can no longer make decisions on their own. Through a process involving the courts, we can assist in having a family member or other appropriate individual appointed to make decisions and oversee the finances on behalf of your incapacitated loved one. The Law Office of Michael Heinemann, PC is experienced in litigating these matters and will walk you through the guardianship process.

Medicaid Applications

A Medicaid application can be extremely overwhelming and complex. Applicants are faced with, among other things, a five-year review of their financial history and often must set up a Qualified Income Trust. A denial of benefits can result in the loss of tens of thousands of dollars based on the cost of long-term care. The Law Office of Michael Heinemann, PC knows the Medicaid regulations and can assist with your Medicaid application to help you get it right the first time. If any complications arise along the way, such as a transfer-penalty or an unexpected denial of benefits, we are known for finding creative resolutions to complicated Medicaid issues and are equipped to take your Medicaid application to an appeal by way of a Medicaid Fair Hearing, should the need arise.
